Yeah fighting back seems like a understandable reaction. But where do you draw the line? Does one kid get to slay another just because the other started it? It's no so clear cut in the thick of things.
No kid should kill another kid due to a response in bullying.
You draw the line at a kid defending himself and it is stopped either with one of the kids on the ground or draw. You can't stop the fight because in my experience that doesn't settle the fight either.

Glad to see that it works out in your case, but I dread to see what happens when this gets out of hand.

That happened to my brother. He fought the kid and that kid wouldn't stop. Harassing my brother and actually hunted down my brother after school a couple of times. At one point, it was suggested by my friends for me to step in. Mind you, I was a full foot taller than my brother and the other kid.
It didn't happen. Actually that kid ended up fighting one of my brothers friends instead and that was that.

I think any reasonable person would draw the line somewhere that's not as extreme and zealous as the "zero tolerance" policies. What those amount to is ensuring that order supercedes justice.
Why are you bringing actual murder into this?

Question, it hasn't been clear to me from the reports I read/listened to/watched (might be due to the advanced hour and sleep deprivation): Apparently the kid's drawing was a response to the drawing of another kid. One of the kids was repeatedly described as a bully or bullying the other, but what I miss out on is, who the bullying kid is. Is it the kid who "drew first" or is it the one that got arrested?
I think we're just supposed to be mad about it happening and the actual drawing and the details of it is a McGuffin.
I don't really care for what anyone supposes I should care about.

OK, here's the relevant bit from the article earlier:
In a letter to the DOE and HPD, the ACLU said the girl identified as “N.B.” — who has ADHD — participated in drawing an offensive sketch of another student in response to being bullied.
“The next day, a parent of one of the kids who received this drawing, was very upset and essentially demanded that they call the police,” said attorney Mateo Caballero, who is representing the student and her mother.
So if I'm reading this correctly: The arrested girl (N.B.) drew an offensive sketch of another student (with the help of other students?), because she (N.B.) was being bullied (presumably by some other student). The next day, the parent of one of the students who received the drawing, demanded the school call the police.
"I know what you’re thinking now. You’re thinking 'Oh my god, that’s treating other people with respect gone mad!'" When I am writing in this font, I am writing in my moderator voice.

So it was indeed not down to me, but the story is indeed complete and utter incomprehensible bullshit from top to bottom? How the flying fuck does the police get involved there and what the hell would warrant an arrest of anybody, no matter the age? What the fuck is wrong in that place and with these people... The US sometimes is really just a caricature of a terrible joke, as told by a flustered mime...

Yes my brother fought back and the kid wouldn't stop. Still harassed and bullied my brother. Then my brother's friend ended up fighting him. That ended it. Was not my brother's fault this kid still wanted to be a bully after the fight.

Hmm my post is gone.
I was saying I would like to see this drawing that gets a 10 year old arrested.
Back in my day (lol/sarcasm) you got sent to the principal's office for everything.
Back in my day the faculty had enough sense to know what to get serious about. God help them about what I drew. I had quite the morbid teenage boy's mind.
What's worse is that this crap applies to everyone. I talked to my 6th/7th grade teacher last year and mentioned how much I loved his teaching style, how it was open and we had discussions about a wide range of topics where we could digress and were encouraged express our opinions.
He thoughtfully chuckled and said if he taught that way now he'd be fired in a month.

Kids should be encouraged to fight back and know that they should make themselves out to be more trouble than they're worth even if they get punished by their school. I did and was encouraged not just by my mom, but by the faculty I knew to take it with pride. They had to punish me, but they knew who the usual suspects were.
