Ok, wait a second.

She gets arrested 5 years ago, and her son is put into custody with a foster family, who eventually decide to adopt him. She contests this process, but is told no by a judge. The Missouri Supreme Court orders a review of the decision, calling it a "travesty of justice." So a SECOND judge reviews everything...and then completely affirms the decision of the first judge?

I can only assume there's more to this story than we're being told. There's always a chance that you get a crazy judge, but the odds of getting TWO crazy judges are a whole lot lower.

You think not? Not so much crazy judge as bad judge.

Granted, my opinion of judges in general may be shaped by the Rumpole of the Bailey series, so take that with a grain of salt.

It's particularly disturbing to me that the new family has changed the kid's name.

Sure, one bad judge could happen. Judges are only human, after all.

But TWO bad judges in a row? Who are both equally bad in the same way? Even when the second one KNOWS this case will be subject to tons of scrutiny?

Math says probably not. Especially since reporting on legal matters is, as a general rule, terrible. It is rivaled only by scientific reporting in that regard.

But hey. It'll be appealed again, so yet ANOTHER judge will have a peek.

From what I can tell, there was a period where the mother was allowed to object to the adoption, and she didn't. But she may not have known she was supposed to. She doesn't speak English, and claims she was not well-served by her attorney.

It's always disconcerting to me how, in cases such as this, people so often forget to consider the most important thing: the long-term developmental health & well-being of the child in question.

Taking a five year old boy from the only family environment he's ever known, and putting him in the care of a bio-mom who is effectively a stranger, would cause lasting psychological harm to this boy. Especially given the fact that unless his foster-parents have been teaching him Spanish, they would not even be able to communicate effectively.

What happened to this woman was a tragic, but we must not create a larger tragedy in attention to rectify it. Giving this woman back her son, would mean taking this boy away from his family.

Unless the adoptive family is shown to be abusive or neglectful in some way, judge made the best call in a shitty situation.
