It would be in Congress' best interest to pass with a margin that will prevent a veto a resolution nullifying such an act.

Let's write this out. Republican congressperson was voted in by people likely in support of stricter border security. Typically these same people also own firearms and support a broadly reaching view of the Second Amendment. President declares dubious emergency. Precedent is set that can be used by all future presidents. Democratic president is sworn in, now with a precedent of having vast powers to declare emergencies with relative impunity. Shooting happens that the president feels is part of a larger emergency in the country...

Republicans should ask themselves which is more important to their constituents: a possibly more secure southern border or keeping in place their ability to prevent a future "gun grab". Right now their decision towards this declaration has little to do with whether they support the construction of additional barriers or not and everything to do with whether they will protect Article I of the Constitution so they have it when the person making the declaration is not saying what they want to hear.

This would be a disaster for the Republican party, and the smart ones know it. It won't be a disaster for Trump, of course, he DGAF. But Republicans would be very wise to head this off at the pass by any means necessary.

I'm not particularly worried about a 'gun grab' - emergency powers don't actually invalidate the Constitution unless the SC says they do, and I don't see the Roberts court going along with that. But there's lots of other issues that the Democrats could leverage this on with a lot more certainty - like climate change.

Like I told my family, a president can actually do a lot, the hard part is getting it to stick. If you look at the history of the executive branch it is full of presidents who brought radical changes only for them to be reversed by their successors. John Adams's term as President was effectively erased as every major decision he did was overturned.

Stuff like the Louisiana purchase, the Emancipation Proclamation and FDR's reforms to the finance industry are the exception, not the rule. Trump also hurt his own case when he signed an executive order to repeal the Affordable Healthcare Act, because what is stopping the next President from signing an order to tear the wall down?

Trump should send Kevin Tighe and Randolph Mantooth to the border. They have a ton of experience dealing with fake emergencies.

Not a bad video. I don't really think hypocrisy is the only thing at stake here though.

Given unanimous Democratic opposition, you'd need 1/3 of the Republicans in congress to override. The question of whether Congress agrees that it's an emergency is more the issue imo.

This is literally the stupidest possible thing Trump could have and has ever done. I think McConnell let him do it and just decided to cut the dope loose. Declaring war on Iran would've been smarter than this, and declaring war on Iran would've been idiocy in the extreme.

I mean, jesus. He even straight-up admitted he "doesn't need to do this", which will give any court in the nation a MANDATE to throw this abuse of power out, and probably Twitler along with it.
