Unless Canada is involved in a joint space program, I don't see that this really matters. Like Antarctic research stations, the nation running a space habitat would likely consider it part of their territory and jurisdiction.

I remember what it was like with the ISS... many years late, massively overbudget, and doing far less than it was supposed to.

It will be. I doubt the first colonists of the Moon will be doing anything unsavory. Burlt once we get to the point of having more than highly trained, disciplined, top of their class people, eventually there will be stealing, assault etc.
