So I learned about this event when this 18 year old says the cops raped her while she was detained. I...I don't think you can give meaningful consent when somebody has locked you up and is holding the key. But it's apparently legal in 35 states? Including mine?

Police are fully capable of having sex off-duty, which they would do if they were willing to meet the most basic standards of professionalism for everyone except rent-boys and escorts.
People who want to do dom/sub stuff can go to get fuzzy handcuffs from the sex shop and a Sexy Police Uniform from a costume shop.

I don't care. The assumption of guilt CANNOT be allowed in the legal system. I don't care if 99% of cases are obvious abuses. NO assumptions.

Changing these laws would not REVERSE the presumption of innocence. It's literally just saying "You're not allowed to fuck somebody you cuffed," and like, adding that into the rules for police conduct.
Why do you have such a strong need for police to be allowed to fuck prisoners during working hours? Like, if a policeman arrested you, tossed you in the back of the car, and then asked you for a blowjob, would you feel safe saying "no thank you"?

If this was a matter of conduct I would be fine with it. If you get fired for sex on the job or a detainee then fine. But having it be a law and jail-able offense just for sex, consent or no, is not OK.

The way I see it, somebody detained by a police officer is no more freely giving their consent to sex than somebody is freely consenting to hand over their wallet to a mugger. Coercion is not consent, and the person slamming you in the back of a paddy wagon is not your friend.

You are literally not forced to consent in such a situation. A mugger forcing you to give your wallet, is a robber. Someone forcing you to have sex with you, is a rapist. Consensual or not, an officer of the law should not be fucking anyone who's in police custody; if for no other reason than it's a potential conflict of interest. You can get your jollies on your own time; while you're on the clock, you are expected to conduct yourself like you have some idea what the word "professionalism" means.
