My own headcanon is the Joker has been killed multiple times but not by Batman, at least not deliberately. The Joker has a small army of imposters, dopplegangers, clown henchmen, and back-ups who are actually as much the Joker as the Joker himself. They adopt his identity, carry out his plans, and often commit various clown-themed crimes on a lesser scale than the Clown Prince himself devises just to keep "his" name in the papers.

Jack Napier (for lack of a better name) has escaped three times in the history of Gotham City and some of them have been for lengthy periods but there's something like sixty Jokers locked up in Blackgate prison or who have gotten themselves killed fighting the Batman, blowing themselves up, or getting gunned down by the police who do not hesitate to do so when Batman isn't directly handing them over in batcuffs.

The mad-dog killer and psychopath Jokers are not the actual Joker-Joker as while Joker is a mass murderer, he has one simple rule:

1. It has to be funny.

Which wearing your own face isn't.

Harley has, notably, dated six of the Joker Clan.

Tim Drake has mentioned this makes Joker a Stand Alone Complex but Batman, surprisingly, doesn't watch anime.

Another bit of headcanon.

A large portion of Bruce Wayne's wealth and why he's mega-rich is that he designed a system for searching the internet for relevant information about cases ranging from trivia to on the spot crime scenes. Alfred pointed out the use and he is, thus, the person responsible for the equivalent of Google. So, every time you use it, you are using the Bat-Computer.

It's called OMAC.

The marriage between Will Riker and Deanna Troi (Star Trek Nemesis) ended in divorce after she started spending a suspiciously large chunk of her off duty hours in the holodeck and he found the "Goddess of Empathy" gown in her closet...

Isn't the simpler answer just that Batman doesn't kill anyone?

After what he's done to Barbara and everyone else, and how many times he's escaped Arkham, at some point you gotta kill him. It's like when Data decided to end the life of Kivas Fajo. As I said, my friend's headcanon is that he's an unknowing agent of Nyarlathotep.

You can ask the same question about anyone though; why doesn't commissioner Gorden kill him? Or any other cop? Or any of the guards or doctors at the asylum? Or literally anyone else who ever has an opportunity?

Why do we put this all on Batman's shoulders?

Pretty much this. The only explanation I'd accept for why it's Batman's responsibility and not the judiciary is if the fact that he's apprehended by a vigilante is itself the reason he's not tried and executed. I'm not sure if that's applicable in the DC universe, especially when things like Suicide Squad get sanctioned by the government.
