Jack Phillips finally wins.

Post by LittleRaven »

Took long enough.
The Colorado Civil Rights Commission announced Tuesday that it will dismiss its most recent charges against cake artist Jack Phillips in the wake of newly discovered evidence of the state’s ongoing hostility toward religious freedom. Alliance Defending Freedom attorneys filed a federal lawsuit, Masterpiece Cakeshop v. Elenis, on behalf of Phillips after the state began to prosecute him even after the U.S. Supreme Court’s ruling in Masterpiece Cakeshop v. Colorado Civil Rights Commission.
Look, when the Supreme Court tells you to stop doing something, maybe you should think twice before doubling down. The optics of that are...bad.

Seems that it was a mistake to attack on the religious front.

However, his statement at the end about his faith being challenged is kinda dubious. You have discrimination provisions that businesses are largely intertwined in, then you have all inclusive languages of religion that imply he's partaking in the celebration by making a cake with two symbolic colors.

Not really. That's the entire basis of why the Supreme Court ruled in his favor. They didn't say the state was entirely wrong to do what they did, they said the state was wrong to attack him on the basis of his faith, which evidence shows they were clearly doing.

Well it became apparent that that's what they were doing. What I'm saying though is that, yeah, the case itself wasn't a losing case, but it seemed like he was making the whole thing overall out to be an attack of his faith. They talk about all the people starting to mock his religious defense to the point where, yeah, they're taking it a few steps too far.

It was a matter of proceeding and not determination by law. That's just from reading this a quick once over, and I'll probably read it again to digest it more.

This is exactly correct. The Supreme Court did not definitively settle the actual issue of exactly what you can and cannot compel an artist to create. It merely said that it was clear Colorado officials were not acting in good faith in this instance, which they clearly weren't.

Which is why it is so surprising that Colorado immediately turned around and doubled down against him. Like, seriously guys, take a hint.
