Holding for months is terrible even in good conditions. Even if they're here illegally, which they might not be. Again, they're not necessarily criminals and if it is a crime, it should be a misdemeanor.
If they cross the border illegally then they're criminals. That's what doing something illegal means. And if you don't detain them then I think you effectively have open borders.

Crossing the border is a misdemeanor as far as I'm finding. And misdemeanors are handled with jail time of up to 12 months I'm also finding.

For all that I disapprove of Trump's behavior and the way he's applied the power and authority of his office... yeah, some of it can be. It's easy to just "blame Trump" for everything after all. Spares us the thought of thinking things through more. It gives us the comfort of a bogeyman to despise.

And as an aside, yes, obviously there is a spectrum between "Completely open borders" and "snatch children from their parents and toss them into cages". We can do better and arguably have the moral obligation to do so, especially when we apply our own morality to the situation, that is, our morality and principles as a nation.

They don't have to be separated right away, though there was a reason to do so, and that happened under Obama as well as far as I can tell. But, by court order, the children have to be released from detention after a while. The Obama administration's response to that was to release whole families when the kids had to be released. If you maintain that approach, then just bring a kid along and you have a get out of jail free card. In practice, I think that gives you the option of either effectively open borders to anyone who can bring a kid along, or very rapid processing on a scale that would take enormous manpower and might just be impossible no matter how many people you throw at the problem.

What's the alternative? That's not a rhetorical question. A wall? Ankle bracelets with GPS? By court decisions, possible refugees cannot be required to come with the paperwork to make the process quick and easy.

Asylum seekers and other refugees are folk fleeing unlivable conditions at home, usually near-certain death. They are *highly motivated* to avoid the appearance of impropriety or to give the host country cause to deny them or send them back.
You give them a court date, ask for their host address (or provide approved hosts if they have no local connections), and can have extremely high confidence they’ll move heaven and earth to make that date.

The alternative is treating people like rational human beings and not violent inhuman criminals. This isn’t hard if you look at the data and engage your entire brain.
