Though TBH I much prefer Chuck's idea on Orion Slave Girl lore as expounded in his review of Enterprise's Bound, and this is now my headcanon on how it works.
Marta was in a Federation prison for the criminally insane. The episode suggests she was some sort of black widow type serial killer, seducing people and murdering them. I doubt the Federation recognizes the supposed slavery of Orion culture as legally enforceable. Perhaps she had been a slave, but somehow she ended up in Federation territory, so Marta was not a slave in whatever part of the Federation she was in when she was arrested for her crimes.

This line always strikes me as an example of Early Installment Weirdness. It's a Trek world that's a bit less idealistic and more rough and grim, and borrows stuff like this that would sound ordinary during the Age of Sail when Privateers and Piracy were just as common as Merchant vessels and all valid occupations if you tire of working directly for the crown in the Royal Navy (as Pike was).

While the actual answer is changing values, I also think Pike is just terrible at humor.
