Well since FTC is actually going to look at those videos it should be enough as extra measure. So clearly people are thinking that COPPA is worse than it actually is.

Right, this has (relatively) nothing to do with the FTC or COPPA, this is all YouTube. Just like ContentID barely resembles the requirements of the DMCA (as broken as it is). These policies are YouTube's way of avoiding the law, and passing the burden onto the content creators. YouTube was sued because they violated the rules, so they're making a policy that over-broadly applies them in a way that has very little to do with the original intent or methods described in the law. It's possibly the Viacom apocalypse all over again.

Which isn't to say that COPPA and the DMCA aren't major problems (because they are quite outdated, even when written, and don't take a lot of important things into account), but in this case it's mostly a scapegoat for YouTube. "We have to do it! It's all the FTC's fault for punishing us vacuuming up data we shouldn't have been!"

Funny enough a lot of this came up precisely because the FTC is updating COPPA; unlike the DMCA, it has a built in mandate to review and update aspects of the law every 10 years or so. Not to say they're perfect about it, it's hard to tell without more technical knowledge of how they're parsing law here, but that's certainly better than MOST government enforcement agencies.

But yeah, this is mostly a YouTube problem. YouTube was willfully collecting data on child users they knew was illegal, and rather than giving creators the means to effectively control what ads and data collection go on their videos, they're trying to create an algorithm that'll be exactly as destructive as the content id system.

It's also worth remembering here: the FTC does not care about adults doing a talk review/video essay about She Ra. They care about Hasbro pinpoint advertising on their giant channel and Pregnant Elsa Spider-man knowing where 4 year olds live.

Exactly.

Unfortunately, a lot of the "sky is falling" panic I've seen on YouTube right now is completely misjudging and poorly explaining the problem.
